Please read these Terms and Conditions ("Terms," "Terms and Conditions") carefully before using the DaisyChord mobile application (the "App") operated by us ("we," "our," or "us").
By downloading, installing, accessing, or using DaisyChord, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these Terms, you must not download, install, or use the App. Your access to and use of the App is also conditioned on your acceptance of and compliance with our Privacy Policy.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use. This license does not include any right to:

The App allows you to submit song requests to us. When you submit a song request, you provide information including song title, artist name, optional email address, and optional additional information ("User Submissions"). By submitting User Submissions, you represent and warrant that:
You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Submissions for the purpose of processing your song requests and improving the App's services. We reserve the right to review, modify, or reject any song request at our sole discretion.
The App, including its original content, features, functionality, design, and software, is owned by us and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
DaisyChord respects intellectual property rights and expects users to do the same. The App displays song lyrics, chords, and other musical content that is provided by our servers. This content is intended for personal, educational use to help musicians learn and practice songs. You are solely responsible for ensuring that your use of this content complies with applicable copyright laws and the rights of copyright holders.
The songs, artists, bands, and chords displayed in the App are provided for informational and educational purposes. We do not claim ownership of the underlying musical works, lyrics, or compositions. If you believe that any content in the App infringes your copyright, please contact us with a detailed notice including: (1) identification of the copyrighted work; (2) identification of the infringing material; (3) your contact information; (4) a statement of good faith; and (5) a statement of accuracy.
You agree not to use the App:
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We do not guarantee that the App will be available at all times or error-free. We may also impose limits on certain features or restrict your access without notice.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF THE USE OF THE APP.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, OR $100, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless us and our affiliates from claims, damages, losses, costs, and expenses arising from your violation of these Terms or your use of the App.
We may terminate or suspend your access to the App immediately, without notice, for any reason including breach of Terms. Provisions that should survive termination will continue to apply.
These Terms shall be governed by the laws of the jurisdiction in which we operate. Disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.
We reserve the right to modify or replace these Terms at any time. Material changes will include 30 days’ notice. Continued use after changes become effective means you agree to the updated Terms.
